Constitution of Chinese trade unions

(the Sixteenth National Congress of the Chinese trade union was partly amended and passed in October 22, 2013).

General provisions

The Chinese trade union is a mass organization of the working class under the leadership of the Communist Party of China under the leadership of the Communist Party of China. It is a bridge and link between the party and the masses of workers and staff, an important social pillar of the state power, and a representative of the interests of members and workers.

The basic duty of Chinese trade unions is to safeguard the legitimate rights and interests of workers.

Chapter I members

Article 1. All enterprises, institutions, organs and other social organizations within the territory of China, with wage income as the main source of living or manual labourers and mental workers who establish labor relations with employers, can join trade unions as members without regard to nationality, race, sex, occupation, religious belief and educational level.

Second workers join the trade union, and I will apply for it voluntarily, approved by the trade union's grass-roots Committee and issue a membership card.

The third member has the following rights:

(1) the right to vote, the right to be elected and the right to vote.

The fourth member fulfills the following obligations:

(1) learn basic knowledge of politics, economy, culture, law, science, technology and trade unions.

(two) actively participate in democratic management and strive to accomplish the tasks of production and work.

(three) abide by the Constitution and laws, practise socialist core values, uphold social ethics and professional ethics, and observe labour discipline.

(four) correctly handle the interests of the three parties of the state, collectives and individuals, and fight against acts that jeopardize the interests of the state and society.

(five) safeguard the unity and unity of the Chinese working class and trade union organizations, carry forward class friendship and do well mutual aid and mutual aid.

(six) abide by trade union regulations, implement trade union resolutions, participate in trade union activities, and pay monthly membership fees.

The relationship between the fifth member organizations varies with the labor (work) relationship.

The second chapter is the organizational system.

The Ninth Chinese trade unions practise democratic centralism. The main contents are:

(two) the leading bodies at all levels of trade unions are democratically elected except for the representative offices they send.

(three) the highest leading body of trade unions is the National Congress of trade unions and the Executive Committee of the all China Federation of trade unions. Local leading bodies at all levels of trade unions are local congresses of trade unions and the Federation of trade unions which they produce.

(four) trade union committees at all levels shall be responsible for and report on their work to members of the same level or members' congresses, and shall be subject to the supervision of members. The general assembly and members' Congress have the right to remove or remove the representatives and trade union committee members elected.

(five) trade union committees at all levels shall implement a system of collective leadership and division of responsibilities. All major issues are discussed and decided by the Committee. Members of the Committee perform their duties according to the collective decisions and division of labor.

(six) the leading bodies at all levels of trade unions often inform the lower level organizations, listen to the opinions of lower level organizations and members, and study and solve the problems raised by them. Subordinate organizations shall report to the higher level organizations.

The emergence of the representatives and committees of the tenth trade union congresses at all levels should fully reflect the will of the electors. The list of candidates should be repeated and discussed fully. By adopting secret ballot, the election can be directly carried out by means of the election method of the difference between the number of candidates and the number of candidates. Formal election can also be carried out by adopting the method of differential election. The list of candidates will be generated and then the official election will be held. The eleventh Chinese trade unions carry out the principle of organization and leadership combined with industry and locality. Members of the same enterprise, institution, organ and other social organizations are organized in a grass-roots organization of trade unions, and a nationwide or local industrial trade union organization is established according to the needs of the same industry or several industries of similar nature. In addition to a few administrative management systems that carry out vertical management, the trade unions of their industrial unions carry out the dual leadership of industrial unions and local trade unions. The leading cadres of industrial unions are all other industrial unions. The leadership system of all industrial unions is determined by the all China Federation of trade unions.

Provinces, autonomous regions and municipalities directly under the central government, cities with districts and autonomous prefectures, counties (flags), autonomous counties and cities without districts shall establish local federation of trade unions. The local federation of trade unions is the leading organ of local local trade union organizations and local organizations of industrial unions. A unified national all China Federation of trade unions has been established throughout the country. The all China Federation of trade unions is the leading organ of all local federation of trade unions and national organizations of industrial unions.

The members of the Executive Committee of the all China Federation of trade unions and the members of the National Committee of the industrial union shall be substitutes, and the members of the local federation of trade unions at all levels and the members of the local industrial trade union committee may also make substitutes.

The twelfth local federation of trade unions at or above the county level may send out representative offices according to their needs.

The trade union committees at all levels above the county level and county level may convene meetings of representatives to discuss and decide on major issues that need to be resolved in time when the two Congress is deemed necessary. The number of Representatives representing the conference and the method of formation shall be decided by the Federation of trade unions convened by the delegates.

The national industrial trade union, the local industrial unions at all levels, the township trade unions and the urban street trade union committees may, in accordance with the principle of joint system and representative system, be composed of the next level trade unions, the principal leaders of democratic elections and appropriate representatives of relevant parties.

The higher level trade union can send personnel to help and guide the staff and workers of the employing units to form trade unions.

Thirteenth trade union congresses at all levels elected the same level funding Review Committee. The Standing Committee of the all China Federation of trade unions shall set up a standing committee, and the Provincial Federation, the autonomous region and the municipality shall have a standing committee. The fund review committee is responsible for examining the expenses and assets management of the trade union organizations and their directly affiliated enterprises and institutions at the same level, supervising the implementation of financial laws and regulations and the use of trade union funds, and receiving the guidance of the higher level trade union finance review committee. The trade union finance examination committee shall be responsible for and report on its work to the general assembly or members' congresses at the same level, and shall be responsible for and report on the work to the trade union committee at the same level during the session of the general assembly.

The higher level funding Review Committee shall examine the expenses and assets management of the next trade union and its directly affiliated enterprises and institutions.

Members of the all China Federation of trade unions' funding Review Committee shall be substitutes, and members of the local general trade union funding Committee and the members of the industrial union funds examination committee with independent management funds may also be substituted.

Fourteenth trade unions at all levels set up women's staff committees to express and safeguard the legitimate rights and interests of women workers. The women's staff committee is nominated by the trade union committee of the same level and is formed or elected on the basis of full consultation. The women's staff committee and the trade union committee are established at the same time, and work under the leadership of the trade union committee of the same level. The women's Staff Committee of an enterprise union is a group member of the women's Federation of a county or county level, and the local federation of trade unions at or above the county level accepts the guidance of the women's Federation.

Fifteenth trade unions at all levels and above the county level should set up legal service organizations to provide services for the protection of the legitimate rights and interests of workers and trade unions.

Trade union organizations at all levels shall organize and represent workers and staff to carry out labor legal supervision.

Article sixteenth the establishment or removal of trade union organizations must be approved by the general assembly or the general assembly of members, and shall be reported to the trade union at the next higher level for approval. If the enterprises at the grass-roots level of the trade union are terminated, or the institutions, organs and other social organizations are revoked, the trade union organization shall be revoked and submitted to the higher level trade union for the record. Other organizations and individuals shall not revoke trade union organizations at will, nor shall they cancel, merge or belong to other working departments of trade union organizations.

The third chapter is the national organization.

The Seventeenth National Congress of Chinese trade unions is held every five years, and is convened by the Executive Committee of the all China Federation of trade unions. Under special circumstances, the chairman of the Executive Committee of the all China Federation of trade unions (FTU), which is proposed by the Executive Committee of the all China Federation of trade unions, may be advanced or postponed through the plenary meeting of the Executive Committee. The number of deputies and the method of election shall be decided by the all China Federation of trade unions.

The eighteenth functions of the National Congress of the Chinese trade union are:

(1) to consider and approve the work report of the Executive Committee of the all China Federation of trade unions.

(two) to consider and approve the report on the expenditures and expenditures of the Executive Committee of the all China Federation of trade unions and the work report of the funding Review Committee.

(three) amend the constitution of China's trade unions.

(four) elect the Executive Committee of the all China Federation of trade unions and the funding Review Committee.

The nineteenth Executive Committee of the all China Federation of trade unions is responsible for implementing the resolutions of the National Congress and leading the trade union work throughout the country.

At the plenary session of the Executive Committee, a chairman, a number of vice chairmen and several members of the presidium shall be elected to form the presidium.

The plenary session of the Executive Committee shall be convened by the bureau at least once a year.

The twentieth session of the Executive Committee of the all China Federation of trade unions shall be exercised by the presidium during the plenary session of the Executive Committee. The plenary meeting of the presidium shall be convened by the chairman.

When the presidium is in session, the chairman of the chairman and vice chairmen shall exercise the powers and functions of the Bureau. The chairman's meeting was convened and presided over by the chairman of the all China Federation of trade unions.

Under the Bureau, the Secretariat is composed of one of the first secretaries and a number of secretaries. Under the leadership of the presidium, the Secretary presides over the daily work of the all China Federation of trade unions.

The establishment of the twenty-first National Union of industrial unions shall be determined by the all China Federation of trade unions.

The establishment of the National Committee of the industrial union, which is approved by the all China Federation of trade unions, can be made in accordance with the principles of the joint system and representative system, and may also be elected by the National Congress of the industrial union. The National Committee has a term of five years. When the term of office expires, a meeting shall be convened as scheduled, and a general election shall be held. The plenary session of the National Congress of the industrial union and the National Committee of the industrial union composed of the principles of the joint system and the representative system are: deliberation and approval of the work report of the National Committee of the industrial union; election of the National Committee of the industrial union or the Standing Committee of the National Committee of the industrial union. An industrial union that independently manages funds, an election fund review committee, and a report to the National Congress of the industrial union or plenary session of the Committee. The Standing Committee of the National Federation of industrial unions is composed of a chairman, a number of vice chairmen and several members of the Standing Committee.

The fourth chapter is local organization.

The trade union congress of twenty-second provinces, autonomous regions and municipalities directly under the central government, cities with districts and autonomous prefectures, counties (flags), autonomous counties and cities without districts shall be convened by the general trade union committee at the same level, and shall be held every five years. Under special circumstances, it is proposed by the general trade union committee at the same level that it can be advanced or postponed through the approval of the higher level trade union. The functions and powers of local trade unions at various levels are:

(1) to consider and approve the work report of the general trade union committee at the same level.

(two) to consider and approve the report on the expenditures and expenditures of the general trade union committee at the same level and the work report of the funding Review Committee.

(three) election of the general trade union committee and the Finance Review Committee at the same level.

The local federation of trade unions at all levels shall implement the decisions of the higher level trade unions and the resolutions of the trade union congresses at the same level, and lead the trade union work in this area, and report to the higher level Federation of trade unions regularly.

According to the need of work, the Federation of trade unions of provinces and autonomous regions may set up representative offices in the region. The Federation of trade unions of municipalities directly under the central government and municipalities directly under the central government may establish trade union organizations at the district level or set up representative offices.

Counties and cities can establish Township trade unions and street trade union organizations in townships and streets.

Twenty-third local trade union committees at all levels elect a chairman, a number of vice chairmen, and several members of the Standing Committee to form a standing committee. The results of the election of the trade union committee, the Standing Committee, the chairman, the vice chairman and the funding Review Committee shall be approved by the Federation of trade unions at the next higher level.

The plenary meetings of the local federation of trade unions at all levels shall be held at least once a year, and shall be convened by the Standing Committee. The Standing Committee of the local federation of trade unions at all levels shall exercise the functions and powers of the committee when the plenary session of the committee is not in session.

The establishment of twenty-fourth local industrial trade unions at all levels shall be determined by the local federation of trade unions at the same level in accordance with the actual situation of the local area.

The fifth chapter is grass roots organization.

Twenty-fifth enterprises, institutions, organs and other social organizations and other grass-roots units should establish trade union organizations according to law. Community and administrative villages can establish trade union organizations. If there are more than twenty-five members, a trade union basic committee should be established. If there are less than twenty-five people, a trade union basic committee can be established alone, or a trade union grassroots committee can be established by more than two members. There are more than ten women members in the grass-roots trade union committee.

Trade unions with more than two hundred employees and enterprises and institutions have set up full-time trade union chairmen. The number of full-time staff members of the trade union shall be determined through consultation between the trade union and the enterprises and institutions.

The grass-roots trade union has the conditions of a legal person and obtains the corporate legal person qualification according to law. The president of the trade union is the legal representative.

The twenty-sixth member general assembly or member congress of the trade union grassroots organizations shall be convened at least once a year. After the proposal of a grass roots trade union committee or more than 1/3 trade union members, a general assembly or a member's Congress can be held temporarily. Trade union members should hold a general meeting at the grass-roots trade unions below one hundred.

The functions and powers of trade union members' congresses or members' congresses are:

(1) to consider and approve the work report of the trade union's grass-roots Committee.

(two) to consider and approve the expenditures and expenditures report of the trade union grass-roots Committee and the work report of the funding Review Committee.

(three) election of trade union grassroots committees and funding review committees.

(four) to replace or remove the representatives elected by them or the members of the trade union committee.

The term of office of the trade union grassroots Committee and the Finance Review Committee shall be three to five years, and the specific term of office shall be decided by the general meeting of the members or the Congress of the members. Under special circumstances, the approval of the higher level trade union may be held in advance or postponed.

The permanent representatives of the members' Congress will have the same term of office as the trade union committee of the unit.

The twenty-seventh members of the trade union grass-roots Committee shall be elected on the basis of full deliberation and consultation by members or members, and the chairman and vice chairmen may be directly elected by the general assembly or the general assembly of members, or be elected by the grass-roots Committee of the trade union. The trade union committee of a large enterprise or institution may set up a standing committee according to the needs of the work and approved by the higher level trade union committee. The results of the election of the trade union's grass-roots committees, standing committees, chairmen, vice chairmen and the funding Review Committee are approved by the trade unions at the next higher level.

The basic tasks of the twenty-eighth trade union grass-roots committees are:

(1) implementing resolutions of members' congresses or members' congresses and decisions of higher level trade unions, and presided over the daily work of grass-roots trade unions.

(two) representatives and staff members shall participate in the democratic management and democratic supervision of their units through the workers' Congress, factory affairs and other forms in accordance with the law. (four) organize staff to carry out labor competition, rationalization proposals, technological innovation and technical cooperation activities, and sum up the promotion of advanced experience. (five) to carry out ideological and political education for employees, encourage and support workers in learning culture, science and technology and management knowledge, and develop healthy cultural and sports activities. (six) supervise the implementation of relevant laws and regulations. We should assist and urge the administration to do well in the aspects of wages, labor safety and health, social insurance and so on. We should do well the collective welfare of workers and staff members, improve the lives of workers and workers, and help the difficult workers. Participate in the investigation and handling of labor safety and health accidents in accordance with the law.

(seven) safeguard the special interests of women workers and fight against discrimination, abuse, destruction and persecution of female workers.

The twenty-ninth trade unions, institutions of education, scientific research, culture, health, sports and other organs, have carried out work from the characteristics of relatively concentrated mental workers, actively understanding and caring for the workers' thoughts, work and life, and promoting the implementation of the party's intellectual policies. Organizing staff to do well in democratic management and democratic supervision of their units, so as to create good conditions for bringing their talents into full play.

The thirtieth trade unions' grass-roots committees can set up branches and workshops (departments) trade union committees in branch factories and departments (departments) according to their needs. The trade union committee of a branch factory or workshop is elected by a general assembly or a member's Congress of a branch, workshop or department, and the term of office is the same as that of the trade union's grass-roots Committee.

The trade unions' grass-roots committees, branches and workshops may set up special committees or specialized groups as required.

A trade union group should be established according to the production (administrative) team and a small trade union leader should be elected democratically, and the trade union group activities should be carried out actively.

The sixth chapter is trade union cadres.

Thirty-first trade unions at all levels, in accordance with the requirements of revolutionizing, youthful, intellectualization and specialization, are striving to build a contingent of cadres who stick to the party's basic line, become familiar with their own businesses, love trade unions and rely on their workers.

Thirty-second trade union cadres should strive to achieve:

(1) conscientiously study Marx Lenin doctrine, Mao Zedong thought, Deng Xiaoping theory, the important thought of "Three Represents" and Scientific Outlook on Development, and learn business knowledge of economy, law and trade unions.

(two) to carry out the party's basic line and principles and policies, abide by the laws and regulations of the state, and forge ahead in reform and opening up and socialist modernization.

(three) be loyal to our duties, work diligently, be honest and clean, respect the overall situation and maintain unity.

(four) persisting in seeking truth from facts, earnestly investigating and studying, truthfully reflecting the opinions, wishes and demands of the staff.

(five) adhere to principles, seek selfish interests, enthusiastically speak for employees, and safeguard the legitimate rights and interests of workers in accordance with the law.

(six) democratic work style, linking with the masses and consciously accepting criticism and supervision from the staff and workers.

Thirty-third trade union organizations at all levels shall manage trade union cadres in accordance with relevant regulations and attach importance to training and selecting young cadres, women cadres and ethnic minority cadres, thus becoming an important base for training cadres.

The chairmen and vice chairmen of the grass-roots trade unions shall not be able to mobilize their work arbitrarily when their term of office is not enough. When the work needs to be mobilized, the trade union committee at the level and the trade union at the next higher level should be agreed.

Thirty-fourth trade unions at all levels set up and improve the cadre training system. We should do well in trade union cadres and colleges and various training courses.

Thirty-fifth trade union organizations at all levels are concerned about the thought, study and life of trade union cadres, supervise and urge the implementation of corresponding treatment, support their work, and resolutely fight against the actions of retaliation against trade union cadres.

Trade unions at county level and above shall set up guarantee rights and interests for trade union cadres, so as to ensure that trade union cadres perform their duties according to law.

Trade unions at county level and above can appoint and hire staff members for grass-roots trade unions.

The seventh chapter is trade union funds and assets.

The management and use of trade union funds and assets as well as the system of examination and supervision of trade union funds shall be formulated by the all China Federation of trade unions.

Thirty-ninth trade union committees at all levels shall compile and approve budgets and final accounts in accordance with the relevant provisions, and regularly report to the general assembly of members or the members' congresses and the trade union committees at the next higher level the budgetary receipts and expenditures and assets management, and accept the examination and supervision by the higher level and the same level trade union finance review committee.
